Warranty Terms and Conditions

This Policy includes:

This warranty covers contracted works as well as additional approved extras provided by Constructum Code. The coverage is subject to specified definitions, conditions, exclusions, and financial limits detailed in the document. Note that this warranty excludes any legal liabilities to third parties and associated costs.
Unless otherwise specified on the Certificate of Warranty, clients are protected for a period of 10 years from the date of certificate issuance against defects and substandard craftsmanship in the contracted works.
Quality Assurance
Constructum Code guarantees the quality of its work, subjected to rigorous inspections and checks. Contractors comply with Building Regulations and authorized Building Control inspections. These inspections ensure adherence to health, safety, and compliance standards. The certificate of completion signifies the end of the contracted works and the commencement of the warranty.
Clients must inspect the completed works thoroughly upon completion and report any defects as part of the snagging process. Claims arising from regulatory changes or inspector errors post-completion are not covered, although support may be offered for third-party claims.
Definitions
Common Areas: Shared parts of multi-ownership buildings under joint ownership or legal responsibility.
Limit of Indemnity: The maximum liability during the warranty period, as stated in the contract or financial limits section.
Major Damage and Consequential Loss: Significant destruction or physical damage caused by defects in design or workmanship, including indirect losses.
Preventative Action: Measures required immediately to prevent potential destruction or damage.
Period of Warranty: The duration specified in the warranty certificate.
Client: The sole property owner of the contracted works covered by this warranty.
Structure: Includes foundations, load-bearing components, roofs, and retaining walls constructed by Constructum Code.
Warranty Coverage
The contractor indemnifies the client for:
- Rebuilding or rectifying works forming part of the original contracted scope, including approved extras.
- Rectifying defects in design, materials, or workmanship.
In claims, Constructum Code may choose to repair, replace, or rectify damages using suitable methods, such as new or old replacements.
Specific Conditions
- Fraud and Misrepresentation: Fraudulent claims void all benefits under this warranty.
- Defect Reporting: Notify defects in writing within 48 hours of discovery.
- Third-Party Works: Ensure Constructum Code has access to inspect defects; third-party inspections or repairs void the warranty.
- Preventative Action: Take reasonable measures to prevent further damage.
- Maintenance Obligations: Conduct regular maintenance to ensure the proper functioning of installed works.
- Competent Actions: Avoid unqualified remedial actions to protect the warranty validity.
- Acceptance: Submitting a claim indicates agreement to all terms and conditions of the warranty.
Exclusions
The warranty does not cover:
- Alterations or modifications post-completion
- Aesthetic changes like discoloration or staining
- Consequential losses beyond specified provisions
- Pre-existing defects
- Damage from humidity, improper maintenance, or misuse
- Personal injury or third-party liabilities
- Wear and tear, including normal dampness and silicone maintenance
- Manufacturer limitations or guarantees
- Damages caused by willful acts or negligence
Financial Limits
The company’s liability is capped at:
- The original contract value
- The lesser amount specified in the relevant insurance policy
Claims Procedure
To file a claim, the client must:
- Notify Constructum Code in writing within 48 hours of discovering a defect.
- Secure evidence of damages until inspection.
- Prevent further damage and contact emergency services if necessary.
- Provide all requested documentation and pay the call-out charge upfront.
Call-Out Charges
Standard call-out charges apply and are refundable if the defect is validated as part of the contracted works. Charges are subject to adjustment over time.
Warranty Transfer
Warranties are non-transferable unless an administration fee is paid. Updates to terms may apply upon transfer, reflecting policy and legislative changes.
